Five Outbound provides a range of IT and business solutions designed to enhance productivity and drive growth. Our services include, but are not limited to:
● Information Engineering: Data Science, Data Engineering, Cloud Engineering, Visualizations, and Talent Acquisition.
● IT Consulting: Business Intelligence, Service Process Automation, Software Development, Machine Learning, Cloud Computing, Automated Testing Solutions, Staffing and Placement, and Online Training.
● Business Consulting: Marketing Services, Sales Consulting, IT Operations Support, and Lead Generation.

The specific scope of services, deliverables, and timelines for each client engagement will be detailed in a separate proposal or statement of work.

3. Merchant of Record

Our order process is conducted by our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

4. Payment and Billing

The fees for our services will be outlined in the individual proposal or statement of work provided to you. We may utilize various billing models, including:
● Hourly Rates: Billed for the actual time spent on the project.
● Project-Based Fees: A fixed fee for the entire project.
● Retainer Fees: A recurring fee for ongoing services.

Payment terms will be specified on each invoice. We accept multiple payment methods through our secure payment processor. Late payments may be subject to interest charges as outlined in your invoice.

5. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Five Outbound or its content suppliers and is protected by international copyright laws. Any intellectual property created as part of our client services, including reports, software, and other deliverables, will be governed by the terms outlined in the individual proposal or statement of work. Our "E-learning" and "Online Training" materials are for your personal and non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from our training sessions.

6. Confidentiality

Both parties agree to keep confidential all non-public information that is disclosed by one party to the other in connection with the services provided. This includes, but is not limited to, business plans, client lists, financial information, and proprietary data. This obligation of confidentiality will survive the termination of our engagement.

7. Client Data

In the course of providing services such as "Data Science" and "Lead Generation," we may have access to or process your data. We are committed to protecting the privacy and security of your data. Our data handling practices are governed by our Privacy Policy, which is incorporated by reference into these Terms. We will use your data only for the purposes of providing the agreed-upon services and will not disclose it to third parties without your consent, except as required by law.

To the maximum extent permitted by law, Five Outbound shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use our services; (b) any conduct or content of any third party on our services; or (c) unauthorized access, use, or alteration of your transmissions or content.

9. User-Generated Content

Should our platform allow for user-generated content in the future, you will retain ownership of any intellectual property rights that you hold in that content. By submitting, posting, or displaying content, you grant Five Outbound a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods.

10. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the services provided by Five Outbound shall be resolved through binding arbitration in Sheridan, Wyoming.
